Received damaged product and not accepting replacement.

I have purchased a phone from flipkart which was delivered on 9 may, as it was a phone I got the option of open box delivery but the assigned person did not check it properly, I found that the phone had scratches and the phone was not properly fixed. So I requested for a replacement, but they rejected without any proper reason, again I registered a complain and got immadiate response. The inspection process took place and I told all my complaints to him and the assigned person also agreed for a replacement but now when the replacement product arrived the Ekart person rejected it saying that we cannot accept this as it had scratch. We tried reaching the Ekart customer care but no response and the flipkart people are saying that it's not their mistake. How long should I use this damage phone I am not getting any response from anyone. And I have been waiting for long now. I cannot wait any longer.
