Sir/Madam,
I filed a complaint in the District Consumer forum Distt South New Delhi on 30.01.2012. Under the provisions of Section 13 (3A) of consumer protection act, the complaint should be decided/disposed off within 3 months, whereas, this forum has taken more than 5 years in disposal of a small complaint.For more than 3 years matter is listed for final arguments. Every time (9 times) the matter is adjourned for next date, by the court. Last, it was fixed for hearing on 6.9.2017. Court started functioning at 11.00 A.M.(Even the High Court and supreme Court starts functioning at 10:30. The matter was called at 12.00 noon. The presiding officer adjourned the matter for 28.02.2018. I insisted for hearing arguments. I was surprised to learn the observations of the Presiding officer that he has already heard arguments in 2 cases. No more arguments can be heard now. I smell foul play. Since the advocate of opposite party is a senior advocate, there may be some understanding to delay the hearing so that Complainant may give up the matter. In my complaint NO. 40/12 I had prayed for Rs 7630, in anticipation that the matter will be over within a year if not in 3 months. Now I had attended the court 22 times and spent more than Rs 10,000 in conveyance, what is the relief to the complainant even if my prayer is accepted in total. The very purpose of enactment of consumer protection act stands defeated in such circumstances. Even the civil court would have decided the matter in 6 years. You will surprise to learn the contents of complaint. A very short complaints with documents on record of the court. The complaint is against tour operator who are cheating the public at large by giving misleading advertisements. On reading the newspaper I booked three tickets for visiting Kathmandu Nepal. As per advertisement the tour package included air fare accommodation and local sight seeing. Travel agency not only over charged, but also harassed at airport and in the name of local sight seeing for 3 days tour, visited pashupati nath temple in 2 hours. Rest of sight seeing was done by me at my own expenses. This simple complaint is pending now for almost more than 5 years.
