Subject –Complaint against Holiday Leisure Club,Mumbai

Dear Sir,
I am “ Rajesh Sonakiya, R/o A1, Flat No. 102, Mohidpark Housing Society, Daman Road Chala, Vapi, Gujarat”, I would like to express my complaint regarding Hotel Holiday Lesure Club, Mumbai through following points:
1. I, Rajesh Sonakiya, had received a call from Holiday Leisure Club company on 13/10/2019 wherein I was informed that I have been invited alongwith my family for Family Lunch at Hotel Blossom, Vapi upon filling up a Gift Card in an organized “Coupon Event” by Holiday Leisure Club company at the premises of Big Bazaar campus, Chala, Vapi.

2. That after several representations and requests being made by the concerned person of Holiday Leisure Club company in regard to the various holiday packages offered, I agreed to the said proposal of Holiday Leisure Club company and visited the said hotel wherein, I was assisted with the concerned persons of Holiday Leisure Club company namely Mr. Rajkumar and Ms. Bhavana alongwith some other team members regarding the holiday packages and mentioned about a “Special Promotional Holiday Package” with additional benefits for availing which I was asked to pay an amount of Rs. 28,000/- (Twenty Eight Thousand only).

That I paid the abovementioned amount after being influenced by the representations made by the concerned persons of Holiday Leisure Club company and signed a Membership Contract with Holiday Leisure Club company on 13/10/2019, but the conflict arose when I received a call from Holiday Leisure Club Customer Care on 14/10/2019 regarding the said “Special Promotional Holiday Package” whereby the Terms and Conditions as discussed by the said concerned officials of Holiday Leisure Club company was inconsistent with the Terms and Conditions as disclosed by the Customer Care Executive of Holiday Leisure Club company.

That thereafter, I tried to communicate with the said Mr. Rajkumar regarding the abovementioned inconsistent and vague Terms and Conditions of Holiday Leisure Club company whereby I was informed that he would receive a confirmation mail regarding to the said “Special Promotional Holiday Package” specifically mentioning all the discussed Terms and Conditions within 24 hours, but unfortunately, even after several attempts made by I in order to communicate with the concerned persons of Holiday Leisure Club company regarding the said issue, I did not received the said confirmation mail from Holiday Leisure Club company.

That on 15/11/2019, I requested for the refund of the said amount from Holiday Leisure Club company but I was not provided proper assistance regarding the said refund, where one of Holiday Leisure Club said concerned officials namely Ms. Bhavna again tried to manipulate I by giving fake promises with regard to the said confirmation mail and the offered and commited services and facilities by Holiday Leisure Club company.

That again in the month of October 2020, I tried to communicate with the concerned persons of Holiday Leisure Club company regarding another holiday planned by I for providing the committed services and facilities by making the necessary arrangements and bookings, but unfortunately I did not received any assistance in this regard as well from Holiday Leisure Club company, and as a consequence I again requested Holiday Leisure Club company for the said refund.

That despite of I’s several attempts to communicate with the concerned persons of Holiday Leisure Club company regarding the refund of the said amount being Rs. 28,000/- (Twenty Eight Thousand only), I has not been getting any response from Holiday Leisure Club end in regard to the said refund given the unjustified and unreasonable delay in service and intentional lack of cooperation from Holiday Leisure Club company as a consequence of which, I has suffered severe and grave loss and harassment.

That in lieu of the aforementioned intentional act of fraud and negligence committed by Holiday Leisure Club side, I has requested them several times for providing the refund but unfortunately, I has got “NO SUPPORT” from Holiday Leisure Club side to resolve this issue which is utterly unprofessional from Holiday Leisure Club end, as a consequence of which, I has claimed for full refund of the abovementioned amount of Rs. 28,000/- (Twenty Eight Thousand only) which I is legally entitled to recover from Holiday Leisure Club company.

9. That being deprived of the facilitated service, I intimated Holiday Leisure Club concern on several occasions by way of telephonic and electronic conversations in respect of the refund however, you have acted like flogging of a dead horse in order to provide any of the aforementioned service.

10. That due to Holiday Leisure Club aforementioned malafide act and conduct I got duped the hard-earned money of I which is hindering I in an erroneous way as I has been facing the tremendous noetic agony and due to the same I has not got able to live the life in own accord.

11. Thus in order to resolve the difficulties , I would request Honorable Consumer Forum to look into this matter with foremost importance to take necessary steps to facilitate I with the refundable amount of Rs. 28,000/- (Twenty Eight Thousand only) which is still due to I along with a compensation amount of Rs. 50,000/- (Rupees Fifty Thousand only) for the mental agony.
12. I have already sent the legal notice to Holiday Leisure Club on 23/02/2021 by courier and on 15/04/2021 by email from mu lawyer but their response is pathetic.
