Auxus 4x phone bought on ebay.in is not as described.

I had bought a smartphone namely Auxus 4x on ebay.in with PaisaPay ID:- 4348986424 on 30/08/16.
I had received the aforesaid smartphone on 06/09/2016 and found that the phone was not as described. The seller of the phone on his product listing on ebay.in specifically said the following to attract buyers like me.
"The metallic sides of the phone gives the Auxus® 4X a premium look and feel when you hold it on your hand."
But in reality the phone did not have any metallic sides whereas it is made of plastic. The phone had various other major technical problems as well.
After that, I raised an ebay guarantee claim with ID No. 2298952 on 11/09/2016 for a refund. But unfortunately today i.e. 18/09/2016. I got an email from ebay that my claim for a refund has been rejected because it is under Manufacturer warranty and hence excluded from eligible transactions for filing a claim under eBay guarantee. Therefore, the claim filed by me falls under non-eligibility criteria and as a result, ebay has closed my claim and my request for refund has been rejected.
After that I called ebay customer care and told the lady that the seller has violated the ebay's search and browse manipulation policy by giving false information about the phone and the resolution she gave me was that now I have to go to the Service Center of the Smartphone and ask them to provide a DOA(Date of Arrival)letter along with a photograph of the phone so that she can help me re-open the claim. Since today is Sunday, the Service Center is closed, I spoke to the authorized service center person over phone and he said that he won't provide any DOA letter since the service center has nothing to do with my ebay refund claim.
Now, that I have been cheated, I have no option than to fight for my refund claim, I hereby request your authority to pursue this matter seriously and help me in this regard.
